Arbitration Attorneys in Washington, DC

Arbitration is a procedure for resolving disputes in which the parties agree to be bound by the decision of a neutral third party. It may be used in the private sector as well as in federal, state and local government employment.

Arbitration is less formal, and therefore is often less costly to the parties than a court proceeding or administrative hearing.

In the FEDERAL SECTOR:

  • Many agencies enter into collective bargaining agreements with their non-management employees.
  • The parties agree to be bound by the decision of an arbitrator. A controversy that otherwise would be submitted to the Merit Systems Protection Board or the Equal Employment Opportunity Commission for an administrative hearing is instead heard by an arbitrator.
  • The arbitrator's decision is then appealable in the same way that an administrative judge's decision is appealable.

In the PRIVATE SECTOR:

  • Employment contracts delineate the rights of the parties to enter into binding arbitration in lieu of going to court.
  • The decision of the arbitrator is final, and there is no right of appeal.
