Employers are required to pay male and female employees the same wage for equal work under similar working conditions. The work must:

In some cases, employers are justified in paying men and women different wages for performing substantially equal work. This occurs when, in setting pay, the employer relies upon a seniority system, a merit system, a system that measures earning by quantity or quality of production, or a differential based on any factor other than the sex of the employee.
