The Whistleblower Protection Act is intended to protect from reprisal federal employees who disclose what they believe to be evidence of waste, fraud, abuse, or threats to health and safety.Proving that the Act has been violated is very complex. Employees must show:
- That they reasonably believed the evidence they disclosed demonstrated "gross" waste, fraud, or abuse;
- That the disclosure was made to a person in a position to remedy the situation; and
- That the disclosure was not part of their job.
Even if an employee has made a protected disclosure and alleges that he or she was subjected to a personnel action because of the disclosure, the agency will avoid liability if it can show that it would have taken the same personnel action even if the disclosure had not been made.
